In the name of God Amen the fifth day of November
one thousand six hundred forty five I Henry Collett of Bourton-on-the-Water in
the County of Gloucester yeoman being weak in body by reason of my sickness but
being of perfect memory thanks be given to God do make and ordain this my last Will
and Testament in manner and form following
First and principally I do commend my soul into the hands of Almighty God hoping by the merits and mercy of my Saviour Jesus Christ to have remission of all my sins and as concerning my temporal estate with which God hath blessed me I bequeath as followeth
I do give and devise unto my son Anthony Collett
and his heirs forever all that my three yard lands lying in Naunton
in the County of Gloucester and all other my lands, tenements and hereditaments in Naunton
aforesaid whereof or whatever I do now stand gifted of my estate of inheritance
all which said premises do lie on the north side of Naunton
aforesaid and I do also give unto my said son the seize of my cottage with the
appurtenances in Naunton aforesaid
And I do also give unto my said son Anthony and his
heirs forever all those my grounds and closes in the Parish of Naunton aforesaid called Harford grounds
with their and every of their appurtenances provided always and my true meaning
is that out of the said lands and premises my said son Anthony and his heirs
shall pay yearly unto my daughter Elizabeth until she shall accomplish the age
of one and twenty the sum of ten pounds of decent English money at the feast of
St Michael the archangel and the annunciation of our blessed lady St Mary the Virgin
by equal portions
And my said son Anthony and his heirs shall also
pay unto my daughter Sarah yearly until she shall accomplish the age of one and
twenty years out of the said lands and premises the like sum of ten pounds of
like money at the feasts aforesaid by even portions
And my will and meaning is that my said son and his
heirs shall out of the said premises pay unto the said Elizabeth my daughter
when she shall accomplish the full age of one and twenty years the sum of three
score and ten pounds of decent English money and unto my said daughter Sarah
when she shall accomplish the full age of one and twenty years the like sum of
seventy pounds of like money
And my will and true meaning is that if the said sums
of money or such of them or any part of them or of any of them shall behind or
unpaid by the space of one and twenty days next after the sum shall be due or
payable by the true meaning of this my Will that thence and from thence forth it
shall and may be lawful to and for my said two daughters jointly or severally to enter upon all or any part of
the said lands and premises and the sum and the profits thereof to have receive
and take until the said two several sums of ten pounds yearly and the said several
sums of seventy pounds shall be finally and respectively paid and satisfied
unto my said two daughters according to the true meaning of this my will

And I do give and devise unto my son Henry Collett
and his heirs forever all that my messuage and also my lands, tenements and hereditaments lying and being in Upper Slaughter in the
County of Gloucester and all the messuages, lands, tenements
and hereditaments lying and being in Stow-on-the-Wold
in the County of Gloucester and all that my close or parcel of ground with the appurtenance
lying and being in Bourton-on-the-Water in the County of Gloucester called the
March provided always and my meaning is that my said son Henry and his heirs
shall pay unto my younger sons
And if the said several sums of eight pounds per
annum or any part of them or of either of them shall be behind or unpaid by the
space of one and twenty days next after the same shall grow due that then in
every of these cases it shall be lawful for my said sons Thomas and John jointly
or severally to enter upon the said houses and premises devised to my son Henry
herein before said and to take and hold the same and the rents and profits
thereof until the said several sums of eight pounds and the arrears
thereof if any shall be shall be unto my
said sons Thomas and John severally and respectively paid and satisfied
And I do will and devise unto my said daughter
Elizabeth the sum of one hundred pounds more of decent English money to be paid
and satisfied when she shall accomplish her age of four and twenty years the
same sum of one hundred pounds to be paid and raised out of the said messuages, lands and premises given and devised unto my said
son Henry as aforesaid and if the same sum of one hundred pounds shall not be paid
unto the said Elizabeth at her said age of four and twenty years then I do will
and my meaning is that my said daughter Elizabeth shall enter upon all the lands
and premises devised to my said son Henry and hold the same and the profits
thereof until the said hundred pounds shall be paid and satisfied unto her
And I do give and devise unto my wife the lease of
the farm called Nethercott and of the six yards, lands
and a half thereunto belonging which I hold at Bourton-on-the-Water aforesaid which
I had from my wife’s father and granted unto him by Sir Thomas Edmonds Knight
deceased and I do give and devise unto my said daughter Sara the sum of one
hundred pounds of decent English money to be paid to her out of my personal
estate when she comes to one and twenty years of age
And I do give and devise unto my said two sons

And I do hereby desire my father-in-law Thomas
Lombard that he will be pleased to give and bestow on my said son Anthony and
his heirs all those lands, tenements and hereditaments
in Naunton aforesaid if not then my will is that my son
Anthony shall have the two hundred pounds which my said father-in-law owes me
Item I do give and devise unto the poor people of
Bourton-on-the-Water aforesaid the sum of twenty shillings and to the poor
people of Naunton the sum of twenty shillings more
and to the poor people of Upper Slaughter the sum of ten shillings
And I do give unto Henry Collett and Judith Collett
both of Slaughter so much wood yearly as is worth five shillings until my said son
Henry Collett shall come to the age of one and twenty years the same wood to be
assigned forth yearly and taken of the premises in Slaughter aforesaid devised
to my said son Henry and the same is to be equally divided yearly between the said
Henry and Judith
Item I do give unto my god-daughter Elizabeth Hall
the sum of five shillings and to all the rest of my god children the sum of
twelve pence a piece
Item I do give and devise unto the poor people of
Stow-on-the-Wold the sum of forty shillings to be taken and paid out of the
next rent that shall be received for my said houses there and I do give unto
every one of my servants the sum of twelve pence
And I do make my loving wife Anne the sole Executrix
of this my last Will and Testament
And I do make my loving friends Mr Charles Trinder and my father-in-law Thomas Lombard and my brother
And my will and meaning is and I do will and devise that if my said son Henry shall die before he come to the age of one and twenty years or have issue of his own body that then my said son John and his heirs forever shall have the said messuages, lands and premises devised to my said son Henry as aforesaid
In witness whereof I the said Henry Collett have hereunto put my hand and seal the day and year first above written Henry Collett these five sheets of paper do contain the last Will and Testament of the within named Henry Collett and the same was published and declared by the said Henry as the last Will and Testament of him the said Henry the day and year within written in the presence of us
